1. Agreement to Terms

Welcome to myWorkForm. These Terms of Service ("Terms") govern your access to and use of the myWorkForm platform, including our website, applications, and services (collectively, the "Service").

By creating an account, accessing, or using myWorkForm, you agree to be bound by these Terms. If you do not agree, you may not use the Service. These Terms apply to all users, including Store Owners (creators who sell products) and Customers (buyers).

2. Description of Service

myWorkForm is a print-on-demand platform that enables Store Owners to create custom apparel stores without holding inventory. When a Customer places an order, myWorkForm produces the item with the Store Owner's design and ships it directly to the Customer.

myWorkForm provides:

• Store creation and hosting tools
• Product mockup generation
• Order processing and fulfillment
• Payment processing (via Stripe)
• Shipping and tracking
• Customer support tools

3. Account Registration

To use certain features of myWorkForm, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be at least 18 years old (or the age of majority in your jurisdiction)
• Not share your account credentials with others
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. User Content and Intellectual Property

4.1 Your Content

You retain ownership of all designs, logos, images, and other content you upload to myWorkForm ("User Content"). By uploading User Content, you grant myWorkForm a worldwide, non-exclusive, royalty-free license to:

• Display your content in your store and product listings
• Generate mockups and product previews
• Print your designs on products for order fulfillment
• Use your content for marketing (only with your explicit permission)

4.2 Content Requirements

You represent and warrant that your User Content:

• You own or have the rights to use and license
• Does not infringe any third-party intellectual property rights
• Does not violate any applicable laws or regulations
• Does not contain harmful, offensive, or illegal material

4.3 myWorkForm's Intellectual Property

The myWorkForm platform, including its design, features, code, and branding, is owned by myWorkForm and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without permission.

5. Acceptable Use Policy

You agree NOT to use myWorkForm to:

• Sell products featuring copyrighted material you don't own (logos, characters, artwork)
• Sell products featuring trademarked names or brands without authorization
• Create or sell content that is defamatory, obscene, or promotes violence
• Sell content that promotes hate speech, discrimination, or illegal activities
• Impersonate another person or entity
• Engage in fraud, deception, or misleading practices
• Attempt to hack, disrupt, or damage the myWorkForm platform
• Use automated systems to scrape or access the Service
• Violate any applicable laws or regulations

myWorkForm reserves the right to review, remove, or refuse any content that violates these guidelines, without prior notice.

6. Store Owner Terms

If you operate a store on myWorkForm, you additionally agree to:

6.1 Pricing and Profits

• You set your own retail prices above myWorkForm's base costs
• Your profit is the difference between your price and the base cost
• myWorkForm processes payments and pays out your earnings according to our payout schedule
• You are responsible for any taxes on your earnings

6.2 Customer Relations

• myWorkForm handles order fulfillment and shipping
• myWorkForm provides first-level customer support for orders
• You may be contacted regarding design-specific questions
• You must respond to customer inquiries in a timely manner

6.3 Subscription Plans

• Free plan: Limited stores and products as specified
• Pro plan: Additional features and unlimited access
• Subscription fees are billed monthly and non-refundable
• You may cancel your subscription at any time

7. Payment Terms

7.1 For Customers

All payments are processed securely through Stripe. By making a purchase, you authorize myWorkForm to charge your payment method for the total order amount, including product costs, shipping, and applicable taxes.

7.2 For Store Owners

Earnings are calculated after each successful order. Payouts are processed according to our standard schedule, minus any refunds, chargebacks, or fees. myWorkForm reserves the right to hold payouts in cases of suspected fraud or policy violations.

8. Order Fulfillment

myWorkForm partners with third-party fulfillment providers to produce and ship orders. We strive to maintain high quality standards, but:

• Production times are estimates and may vary
• Shipping times depend on carrier and destination
• Colors may vary slightly from mockups due to printing processes
• myWorkForm is not responsible for shipping delays caused by carriers

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYWORKFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

MYWORKFORM'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO MYWORKFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless myWorkForm, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

myWorkForm may suspend or terminate your account at any time for any reason, including violation of these Terms. You may also delete your account at any time through your account settings.

Upon termination:

• Your access to the Service will be revoked
• Your stores will be taken offline
• Pending orders will be fulfilled
• Outstanding earnings will be paid according to our payout schedule
• Your User Content may be deleted

12. Dispute Resolution

Any disputes arising from these Terms or your use of myWorkForm shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to participate in class action lawsuits.

Before initiating arbitration, you agree to contact us at [email protected] to attempt informal resolution for at least 30 days.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of myWorkForm after changes constitutes acceptance of the new Terms.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and myWorkForm.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms. myWorkForm may assign them freely.
• Governing Law: These Terms are governed by the laws of the State of Delaware, USA.
